6:30 PM Public Hearing

  1. Area Variance for 19B Devitt Road. Lisa Delaney proposes to tear down an existing pool house and replace it with a 24’ x 32’ pool house with two attached 18’ x 18’ roof covered patio wings. The new structure will cover 1524 sf. An area variance is necessary because the peak of the main roof will be 27’-1” high. The maximum allowed height for an accessory structure is 15’-0”. Therefore, a variance of 12’-1” will be required. Tim Gallagher of Architexny.com will present the plan.

6:45 PM Regular Meeting  

1. On January 31 st , the Town Board appointed John Audi of 3 Erie Court to a 5 year term as a member of the ZBA.

 

2. Area Variance for 19B Devitt Road. See above Public Hearing.

 

3. Interpretations - The Planning Board has had several requests for interpretations regarding sections of Town Code and would like the ZBA to issue an interpretation. Attorney Don Boyajian has provided a Legal Memorandum on the two questions and the Board will consider adoption of the interpretations which involves:

A. How to measure road frontage in establishing minimum road frontage for parcels; and

B. The need to require site plan review for when an addition greater than 25% of the dwelling size is created for a one or two-family home.

 

4. 124 Middletown Road – Gordon Associates has purchased approximately 13 acres of land on Middletown Road and is considering building apartments on the property. Because of the zoning requirements, a maximum of nine units is allowed without variances. The applicant could build more units utilizing a PDD, but does not qualify for a residential PDD. Gordon Associates and their engineer, Bohler Engineering would like to informally discuss potential options with the ZBA before pursuing a course of action.
